FundedInk End User License Agreement
Version 2026-10-17 · Effective date: to be set at release
This End User License Agreement (the "EULA") is a legal agreement between you and the operator of FundedInk ("FundedInk", "we", "us") for the FundedInk Trading Journal desktop software, including its updates, documentation and bundled content (the "Software"). FundedInk is an independent software product developed and operated from Utah, United States; "FundedInk" is a product and brand name, not the name of a registered company. The Software is licensed, not sold. By ticking the agreement box, installing, or using the Software you agree to this EULA. If you do not agree, do not install or use the Software.
The Terms of Service govern the account, purchase and support features that go with the Software, and the Licensing Policy explains how the license is checked. This EULA governs the Software itself.
1. Ownership and copyright
The Software is owned by us or our licensors and is protected by United States and international copyright, trademark and other intellectual-property laws. © 2026 FundedInk. All rights reserved. The FundedInk name and logo are used as trademarks; no trademark registration is claimed. You get the rights set out in this EULA and nothing more. The data you put into the Software (your journal) is yours.
2. License grant
Subject to this EULA and, for paid use, a valid purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to:
- install and use the Software, signed in with your own FundedInk account, on up to three (3) computers running Windows or macOS that you personally own or control at the same time, for your own use;
- make copies of the Software only as needed for installation and backup;
- use the output you create with the Software (recap images and videos, exports) for any lawful purpose, including sharing it.
"Your own use" includes keeping the journal of trading you do yourself, whether as a hobby or as your business. It does not include operating the Software for other people as a service, embedding it in another product, or letting anyone else use your license.
The Software unlocks its licensed features by checking, while your FundedInk account is signed in, that the account holds a license (see the Licensing Policy); it uses no license key, serial number or activation code. Replacing a computer, reinstalling the operating system or the Software, travelling and using a VPN are all ordinary use. A computer you stop using frees its place after 30 days of inactivity, or at once when you release it in Settings → License. The Licensing Policy describes this in detail.
3. What you may not do
Except as expressly allowed by this EULA or by law that cannot be excluded by contract, you may not:
- copy, distribute, sell, rent, lease, lend, sublicense or otherwise transfer the Software, your account or your license to anyone else;
- share your sign-in or let anyone else use your license, including family members, trading groups or business partners;
- resell or distribute license tokens, credentials or copies of a licensed installation;
- modify, adapt, translate or create derivative works of the Software;
- decompile, disassemble or reverse engineer the Software, except to the extent the law of your jurisdiction expressly permits it despite this restriction (for example, to achieve interoperability), in which case you agree to ask us first for the information you need;
- remove or alter any copyright, trademark or other proprietary notice;
- work around, disable, forge or interfere with the Software's license verification, security features or developer-mode safeguards;
- use another account or identity to get around a suspension or closure of your account;
- use the Software to develop a product that copies its code, design or distinctive appearance;
- use the Software in breach of the Terms of Service or of any law.
4. Personal and commercial use
Your license covers your personal trading records and the records of a trading business you run yourself, including recaps you post or share. It does not cover providing journaling, analytics or reporting to third parties as a service using the Software, nor use by an organization across many users; contact us at support@fundedink.com for those arrangements.
5. Updates
We may release updates to the Software at our discretion. Updates may add, change or remove features, and may be required to keep online features working. Updates you install are covered by this EULA unless they come with their own license terms. A lifetime license includes the updates we release; it is not a promise that updates will be released.
6. Open-source and third-party components
The Software includes open-source and third-party components. Their licenses, listed in the Open Source Notices available in the Software and in the file legal/THIRD_PARTY_NOTICES.md, apply to those components. Where an open-source license gives you rights that this EULA would restrict, the open-source license governs that component.
7. Third-party platforms
The Software can read data exported from, or sent by, third-party trading platforms. Those platforms are not part of the Software, are not under our control, and are subject to their own terms. The Software does not place orders, execute trades or copy trades, and you may not use it to attempt to do so.
8. Developer and test features
The Software contains developer tools that are disabled in the versions we distribute to customers and cannot be enabled by changing a nickname, a badge or a setting inside the application. Attempting to enable privileged features in a customer build, or to use test personas to impersonate anyone, is a breach of this EULA.
9. Term and termination
This EULA lasts for as long as you use the Software. If you breach it, we may end your license, but only in the way the Account Termination Policy describes: by a decision of an authorized person, for a recorded reason, with notice to you and a right of appeal; never automatically. We may also end your license where a purchase is refunded, reversed or found to be fraudulent. When your license ends you must stop using the Software's licensed features and delete your copies, except that you may keep reading and exporting your journal. Your journal data remains yours; sections 1, 3, 10, 11 and 12 survive termination.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Software is provided "as is" and "as available". We disclaim all warranties, express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Software will meet your requirements, operate without interruption or error, or that defects will be corrected.
Limited remedy. If the Software does not work on your computer and we cannot fix the problem within a reasonable time after you report it, your remedy is a refund of the purchase price as described in the Refund Policy.
Some jurisdictions do not allow the disclaimer of implied warranties, or limit how long they may be disclaimed, so some of the above may not apply to you. Where an implied warranty cannot be disclaimed, it is limited, to the extent allowed, to a period of 90 days from purchase.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, trading losses, loss of data, or the cost of substitute software, arising out of or relating to the Software or this EULA, under any theory of liability, even if advised of the possibility. To the fullest extent permitted by law, our total liability under this EULA is limited to the amount you paid for the Software or US $25, whichever is greater.
These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.
12. Governing law
This EULA is governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules, except where mandatory consumer-protection law where you live applies and gives you more protection. Disputes are handled as described in the Terms of Service.
13. Export control
You agree to comply with United States export laws and regulations and not to export or re-export the Software to any country, person or entity where that is prohibited.
14. Consumer rights
If you are a consumer, nothing in this EULA affects the rights you have under the laws of your country or state that cannot be waived by agreement.
15. Whole agreement
This EULA, together with the Terms of Service, the Licensing Policy, the Account Termination Policy and the documents they reference, is the whole agreement about the Software. If a provision is unenforceable, the rest remains in force. We may update this EULA for new versions of the Software; the Software will show you a changed EULA and ask you to accept it before continuing.
